Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the website at mrmidnight.com and its related subdomains, content, and services (the "Site"), operated by Midnight Gaming LLC. It applies to everyone who uses the Site, and especially to any content you submit or activity you take part in — including wiki entries and edits, forum posts, comments, reviews, messages, and account activity ("User Content" and "conduct"). Pursuant to 47 U.S.C. Section 230(d), we hereby notify you that parental control protections (such as commercially available computer hardware, software, or filtering services) may help you limit access to material that is harmful to minors. Information about current providers of such protections is available through a web search or through the parental-control settings built into most devices and operating systems.

This AUP is part of, and incorporated into, our Terms of Service, and is governed by them. The Terms of Service set out the governing law, dispute resolution, limitation of liability, and other terms that apply to your use of the Site. Violating this AUP is a violation of the Terms. We enforce this AUP to keep the community safe, lawful, and useful.

By using the Site, submitting content, or participating in the community, you agree to this AUP.

1. Core Rule: No Illegal Activity

You may not use the Site, or submit any content, for any purpose that is unlawful or that promotes, facilitates, or encourages illegal activity. This includes, without limitation:

• Violating any applicable local, state, national, or international law or regulation.
• Posting, linking to, or distributing content that is illegal, or that facilitates illegal acts.
• Using the Site to plan, coordinate, promote, or carry out criminal activity of any kind.
• Trafficking in illegal goods or services, including illegal drugs, weapons, stolen property, or contraband.
• Distributing malware, ransomware, exploits, or other malicious code, or providing instructions intended to enable unlawful hacking, fraud, or attacks.
• Engaging in fraud, phishing, scams, money laundering, or deceptive financial schemes.
• Facilitating human trafficking, exploitation, or any form of abuse.

Zero tolerance for child sexual abuse material and child endangerment. You may not post, link to, request, or facilitate any child sexual abuse material (CSAM), any sexualized content involving minors, or any content or conduct that endangers, exploits, grooms, or sexualizes anyone under 18. We report such material and activity to the appropriate authorities, including the National Center for Missing & Exploited Children (NCMEC) where required, and cooperate fully with law enforcement. Accounts involved are terminated.

2. Prohibited Content

You may not post, submit, link to, or transmit content that:

• Infringes intellectual property — including copyrighted material, trademarks, trade secrets, game assets, or other proprietary content you do not have the right to share. Do not upload pirated games, cracked software, leaked assets, ROMs, or copyrighted media you do not own or have permission to post. (See our Terms for copyright complaints/DMCA.)
• Is hateful or harassing — content that promotes violence against, threatens, degrades, or dehumanizes people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or other protected characteristic.
• Harasses, bullies, threatens, or intimidates any person, including targeted harassment, stalking, or encouraging others to do so.
• Is sexually explicit or obscene, including pornography. (Any sexual content involving minors is covered by Section 1 and results in reporting and termination.)
• Is violent or graphic in a way intended to shock, glorify harm, or incite violence, or that promotes or provides instructions for self-harm, suicide, or harm to others.
• Is defamatory — false statements that harm a person's or organization's reputation.
• Violates privacy — sharing another person's private or personal information without consent ("doxxing"), including addresses, phone numbers, financial data, or other identifying information.
• Is spam or deceptive — unsolicited advertising, chain messages, pyramid schemes, mass unsolicited posting, misleading links, or artificially manipulating content, votes, ratings, or rankings.
• Impersonates any person or organization, or misrepresents your affiliation with any person or organization, including Mr. Midnight, its staff, or moderators.
• Contains malicious code or attempts to interfere with, compromise, or gain unauthorized access to the Site, other users, or any systems.
• Is knowingly false or misleading in a way intended to deceive the community, including deliberately false wiki information or fabricated reviews.

3. Prohibited Conduct

You may not:

• Abuse Site features — including the wiki, forums, comments, reviews, newsletter, contact form, accounts, or store — to spam, harass, deceive, or disrupt.
• Circumvent moderation or enforcement — evade bans or suspensions (including by creating new accounts), tamper with change logs, or undermine wiki version tracking or moderation.
• Attack the Site or its infrastructure — attempt to gain unauthorized access, probe or scan for vulnerabilities, breach security or authentication, overload or disrupt the Site (including denial-of-service), or interfere with other users' use of the Site.
• Scrape or harvest — use bots, crawlers, scrapers, or automated means to extract data or content except as expressly permitted, or collect other users' information for unauthorized purposes.
• Misuse accounts — share, sell, or transfer accounts; access another user's account; or provide false registration information.
• Manipulate community systems — use multiple accounts, bots, or coordinated activity to inflate votes, ratings, reviews, rankings, engagement, or visibility.
• Interfere with commerce — engage in fraudulent purchases, payment fraud, chargeback abuse, or misuse of the store or payment features (when available).
• Reverse engineer or copy the Site — copy, modify, or create derivative works of the Site's software, design, or systems except as permitted by law or these policies.
• Use the Site to harm others in any way not otherwise listed but inconsistent with a safe, lawful community.

4. Wiki, Comments, and Community Participation

Because the Site allows users to contribute to a shared knowledge base and community, additional expectations apply:

• Contribute in good faith. Wiki entries and edits should be accurate, relevant, and made in good faith. Do not vandalize, insert false or misleading information, or sabotage others' contributions.
• Respect moderation and editorial control. Community and wiki content is moderated. We and authorized moderators may edit, reformat, correct, remove, or reject contributions, and wiki content may be changed, merged, or superseded under a change-logged model. Do not attempt to override or evade this.
• Keep discussions civil. Disagreement is fine; harassment, personal attacks, and abuse are not.
• Stay on topic and lawful. Community spaces are for gaming-related discussion and contribution, not for prohibited content or conduct described in this AUP.
• No unauthorized commercial activity. Do not use community spaces for unauthorized advertising, solicitation, or self-promotion.

5. Reporting Violations

If you see content or conduct that violates this AUP, report it to us at report@mrmidnight.com (or through any in-Site reporting tools we provide). Include enough detail to locate the content. We review reports and take action as we deem appropriate. While we are not generally obligated to act on every report and reporting does not create a guarantee of action, Midnight Gaming will comply with all mandatory legal reporting requirements, including those related to child safety and illegal activity as required by 18 U.S.C. Section 2258A and other applicable federal laws.

6. Enforcement

We enforce this AUP at our discretion. Depending on the violation, we may:

• Edit, remove, or refuse to publish content;
• Issue a warning;
• Restrict, suspend, or terminate your account or access to features;
• Ban you from the Site;
• Remove or reverse manipulated votes, ratings, or rankings;
• Preserve information and cooperate with law enforcement; and
• Report illegal activity to the appropriate authorities.

We may take any of these actions with or without notice. We may also take action for conduct outside the Site if we reasonably believe it threatens the Site, our users, or our community. Serious violations — including those in Section 1 — may result in immediate termination and referral to authorities.

We are not responsible for User Content submitted by others and do not endorse it. We may, but are not required to, monitor content and conduct.

7. Changes to This AUP

We may update this AUP from time to time. The "Last updated" date reflects the most recent version. Your continued use of the Site after changes take effect constitutes acceptance.
