This Privacy Policy explains how Midnight Gaming LLC ("Mr. Midnight," "we," "us," or "our") collects, uses, and shares information when you use the website at mrmidnight.com and its related subdomains, content, and services (the "Site").
Our approach to your privacy. We are a privacy-conscious gaming destination. We collect what we need to run the Site and serve our community, and we aim to keep that footprint small. We do not sell your personal information. We do not give advertisers or partners access to granular, individual-level personal data about you except in the limited circumstances described in this Policy. Where we work with partners, we favor aggregated, de-identified, or limited information over individual profiles.
This Privacy Policy is part of, and incorporated into, our Terms of Service. Your use of the Site is also governed by the Terms of Service, which set out the governing law, dispute resolution, limitation of liability, and other terms that apply to your use of the Site.
By using the Site, you agree to this Policy. We do not knowingly collect personal information from children under 13. If you are under the age of 13, you may not provide any personal information to us or on the Site unless we have received verifiable parental consent in accordance with the Children's Online Privacy Protection Act. If you do not agree, do not use the Site.
1. Information We Collect
1.1 Information you provide.
- Newsletter signup: your email address and the location on the Site where you signed up.
- Account registration: when accounts are available, information you provide to create and manage an account, such as a username, email address, and password (passwords are stored in hashed form, not in plain text).
- Contact form: your name, email address, and the message you send.
- User Content: content you submit — wiki entries and edits, forum posts, comments, reviews — and information associated with it (such as your username and submission time).
- Purchases: when the store is available, information needed to process an order, such as name, shipping/billing address, email, and order details. Payment card details are collected and processed by our payment processor, not stored by us in full.
1.2 Information collected automatically. When you use the Site, we and our service providers may automatically collect:
- Device and usage data: IP address, browser type, device type, operating system, referring pages, pages viewed, links clicked, and timestamps.
- Security and anti-abuse data: IP address, user-agent, and similar signals associated with form submissions and account activity, used to prevent spam, fraud, and abuse.
- Cookies and similar technologies: as described in Section 5.
1.3 Information from analytics and embedded content. We use third-party analytics and may embed third-party content (such as videos or social widgets). These providers may collect information about your interactions with the Site, as described in Sections 4 and 5.
We do not intentionally collect sensitive personal information, and we ask that you not submit it through User Content or the contact form.
2. How We Use Information
We use information to:
- Operate, maintain, and improve the Site and its features;
- Send the newsletter and, where applicable, respond to your contact-form messages and send service-related emails (such as a welcome or confirmation email);
- Create and manage your account and enable community participation;
- Display, moderate, and maintain User Content, the wiki, and community features;
- Process and fulfill purchases and provide related support (when the store is available);
- Detect, prevent, and address spam, fraud, abuse, security incidents, and violations of our Terms or Acceptable Use Policy;
- Understand how the Site is used, measure and improve content and performance, and inform our editorial and business decisions (including through analytics, generally in aggregated or de-identified form);
- Comply with legal obligations and enforce our agreements.
Legal bases (where applicable, e.g., for EEA/UK users). We process information as necessary to provide the Site and perform our agreement with you, based on your consent (for example, for certain cookies, marketing emails, and analytics where required), to comply with legal obligations, and for our legitimate interests in operating and securing the Site, where those interests are not overridden by your rights. Your rights regarding your personal information are described in Section 6.
3. Email and Marketing Communications
3.1 Newsletter. If you sign up for our newsletter, we send you updates using an email service provider. Every newsletter email includes an unsubscribe link and a one-click unsubscribe header. You can opt out at any time; when you do, we stop sending and record your opt-out with us and with our email provider.
3.2 Service emails. Some emails are transactional — for example, a confirmation that we received your contact-form message, or, when accounts exist, account and order-related notices. These relate to your use of the Site and are not marketing; they are sent even if you have opted out of the newsletter, as permitted by law.
3.3 Your choices. You can unsubscribe from the newsletter using the link in any newsletter email or, where available, through your account settings.
4. How We Share Information
We share information only as described below: (a) with service providers who perform services on our behalf, such as email delivery, web hosting, and payment processing; (b) if we believe disclosure is necessary to comply with a legal obligation, protect our rights, or prevent fraud; and (c) in connection with a merger, sale of assets, or financing where user information is transferred as a business asset. We do not sell your personal information, and we do not provide advertisers or partners with access to granular, individual-level personal data except as limited here.
4.1 Service providers. We share information with vendors who perform services for us — such as hosting, email delivery, analytics, payment processing, and anti-abuse — under agreements that limit their use of the information to providing services to us. These providers process information on our behalf.
4.2 Analytics and advertising technologies. We use analytics providers and may use advertising-measurement technologies (see Section 5). These may involve sharing certain online identifiers and usage data with those providers so we can understand and improve Site performance and, if we advertise, measure the effectiveness of our own promotions. We aim to limit this to what is necessary for measurement and to favor aggregated or de-identified reporting. We do not use these technologies to disclose your name, email, or contact details to advertisers.
4.3 Business partners. From time to time we may work with business partners — which may include advertisers, sponsors, service partners, or potential investors or acquirers. Our default is to share aggregated or de-identified information (for example, audience size, general engagement metrics, or trends) that does not identify you individually. In limited cases, a legitimate business relationship may reasonably require sharing some additional information; where it does, we will limit what is shared to what is reasonably necessary, and we will not share more than the relationship requires. We will not sell your personal information, and any such sharing remains subject to this Policy and applicable law. Where the law requires your consent for a particular type of sharing, we will obtain it.
4.4 Public content. User Content you submit to public areas — such as forum posts, public comments, wiki contributions, and reviews — is visible to others by design, along with your username. Do not post information you want to keep private.
4.5 Corporate transactions. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to this Policy or a successor policy consistent with it.
4.6 Legal and safety. We may disclose information if we believe in good faith that it is necessary to comply with a law, regulation, legal process, or governmental request; to enforce our Terms or Acceptable Use Policy; to detect or address fraud, security, or technical issues; or to protect the rights, property, or safety of Mr. Midnight, our users, or the public.
4.7 With your direction. We may share information when you ask us to or otherwise direct us to.
5. Cookies, Analytics, and Tracking Technologies
5.1 What we use. We and our service providers use cookies and similar technologies (such as pixels, tags, and local storage) to operate the Site, remember preferences, keep you signed in (when accounts exist), measure usage, and support security and anti-abuse.
5.2 Analytics. We use analytics services — which may include Google Analytics — to understand how visitors use the Site. These services set cookies or use similar technologies and collect usage and device information. Information collected through Google Analytics is subject to Google's practices; you can learn more and opt out through Google's tools (for example, the Google Analytics opt-out browser add-on).
5.3 Advertising/measurement pixels. We may use advertising-measurement technologies — which may include the Meta (Facebook) pixel — to measure the performance of promotions and understand audiences. These technologies may set cookies and share online identifiers and event data with the provider. You can manage many such technologies through your browser settings and the provider's ad-settings controls.
5.4 Your choices. Most browsers let you block or delete cookies and control tracking. Some parts of the Site may not function properly without certain cookies. Where required by law, we present a cookie/consent choice and honor your selection; you can change it at any time through the mechanism provided. We also honor recognized browser-based opt-out signals where required. For users under the age of 13, we do not knowingly collect personal information without first obtaining verifiable parental consent in accordance with federal law. If we learn we have collected personal information from a child under 13 without parental consent, we will delete that information promptly.
6. Your Privacy Rights
Depending on where you live, you may have rights regarding your personal information, such as the right to access, correct, delete, or receive a copy of it, to opt out of certain processing, and to withdraw consent. Because we do not sell personal information, there is no sale to opt out of; where applicable, you may still opt out of certain sharing for cross-context behavioral advertising as described above.
To exercise a right, contact us at privacy@mrmidnight.com. We will respond as required by applicable law and may need to verify your identity. You will not be discriminated against for exercising your rights. If an authorized agent submits a request on your behalf, we may require proof of authorization.
Account and content. When accounts are available, you can review and update certain information in your account settings and request account deletion. Note that public User Content and content others have interacted with (such as quoted forum replies or accepted wiki edits) may remain on the Site as described in our Terms, and de-identified or aggregated data may be retained.
7. Data Retention
We keep information for as long as needed to provide the Site and for the purposes described in this Policy — for example, to maintain your account and the community, fulfill orders, comply with legal obligations, resolve disputes, and enforce our agreements. Newsletter data is kept until you unsubscribe or we no longer need it. Security and anti-abuse logs are kept for a limited period appropriate to their purpose. When information is no longer needed, we delete or de-identify it.
8. Security
We use reasonable technical and organizational measures designed to protect information, such as encryption in transit, hashed passwords, access controls, and loopback-only database access on our servers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
9. Children's Privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information as quickly as possible. Parents or guardians who believe a child under 13 has provided us personal information may contact us at privacy@mrmidnight.com to review the information collected, request its deletion, or refuse to permit further collection or use of the child's information. Users under 18 should use the Site only with parental or guardian involvement, as described in our Terms.
10. International Users
We operate from the United States. If you access the Site from outside the United States, your information may be transferred to, stored in, and processed in the United States and other locations where we or our service providers operate, which may have different data-protection laws than your jurisdiction. By using the Site, you acknowledge that your information may be transferred to and processed in the United States. For users in the European Economic Area, United Kingdom, or Switzerland, we ensure a similar degree of protection is afforded to it by implementing at least one of the following safeguards: transferring data to countries deemed adequate by the European Commission, or using specific Standard Contractual Clauses approved for use in those jurisdictions.
11. Third-Party Sites and Content
The Site links to and embeds third-party content and services. This Policy does not apply to third parties. We are not responsible for the privacy practices of third-party sites or services, including embedded video platforms, social media, analytics providers, and payment processors. Review their privacy policies.
12. Changes to This Policy
We may update this Policy from time to time. The "Last updated" date reflects the most recent version. Material changes will be indicated by updating that date and, where appropriate, by additional notice. Your continued use of the Site after changes take effect constitutes acceptance.
